Benefits2work.com is probably the domain that has featured the most over the years. A site that has been promoted and has its own Youtube and Facebook pages. It has its Content management system with the ability to post Jobs and carries posts from Welfare news for the last few years. Registration is free and information can be of use on many subjects.

The two specific areas that Sanctions normally relate to are JSA  ( Job Seekers Allowance ) and ESA (Employment Support Allowance) Though Universal Credit may also feature as time evolves

Categories of JSA “sanction”
The Select Committee". We recommend that DWP make a clear distinction—in its processes, its communications with claimants, and in the official data—between claimants who are not meeting the underlying conditions of entitlement, in particular those who are genuinely “not actively seeking employment” and may therefore be abusing the system, and those who have not fully complied with the precise terms of a Claimant Commitment. At the moment, both receive the same penalty.  We recommend that the Government confirm the steps it has taken to ensure that suspensions of JSA payments where the JCP Work Coach believes that the claimant has not been “actively seeking employment” do not occur before good reason can be considered, and a decision made, by a Decision Maker detached from the employment support process. DWP should set out the steps it has taken to address this issue, to provide assurance that the newly instituted procedure of making decisions in these circumstances within two days of referral is sufficiently robust to ensure that the decision has in fact been made, and the claimant notified, before the JSA payment is suspended. We also believe that notification should be by either written or telephone communication, depending on the claimant’s preferences as previously expressed to JCP staff when signing the Claimant Commitment, or subsequent to this. Review of the legislative framework for sanctioning Given the complexity of the existing legislation, there is a strong case for a review of the underpinning legislative framework for conditionality and sanctions, to ensure that the basis for sanctioning is clearly defined, and safeguards to protect vulnerable groups clearly set out. We recommend that the clarity and coherence of the legislative framework for benefit sanctions policy be included in the terms of reference of the full independent review which we have recommended.
Use of Jobseeker Directions
We note the concern expressed by some witnesses that use of Jobseeker Directions has increased in some JCP offices in recent years. While we appreciate that there may be circumstances in which it might be appropriate for JCP staff to mandate a JSA claimant to undertake a very specific type of work-related activity, such as particular skills training, it is not immediately clear why such activities could not invariably be included in Claimant commitments. Intuitively we would expect there to be minimal, if any, use made of Jobseeker Directions, as the Claimant  Commitment becomes more firmly established. We recommend that DWP’s evaluation of the Claimant Commitment include an assessment of the appropriate use of Jobseeker Directions and their interaction with the Claimant Commitment process.
  ESA sanctioning
Employment and Support Allowance (ESA) is a relatively new benefit; it was introduced in 2008 as a replacement for incapacity benefits (IB), for unemployed people with long-term health conditions and disabilities. ESA claimants considered to have “limited capability for work”, but with the capability to undertake “work-related activity” and considered to have a reasonable prospect of being able to work in the future, can be placed in the ESA Work-related Activity Group (ESA WRAG). These claimants are subject to a more limited range of conditionality than JSA claimants—attendance at mandatory  work-focused interviews at JCP and/or mandatory participation in the Work Programme

In the U,K a person who leaves a job voluntarily can be sanction or have their money stopped for a period of 3 months. The sanction is in respect of behavior.
The claimant has to make contact with an office in the Midlands. Whilst the letter seen here was in respect to the termination of a job in November it takes until the 13/1 for the letter to be sent.

The letter seen here is in respect of a sub contracted job. The job seeker had worked for a cleaning company, that had a contract with a major chain.
The manager of the major chain had sacked the Job seeker, however the Job seeker had had work with other companies and is expecting work in the future
The form is sent out with a sae ( stamp addressed envelope for the claimant to complete and return

DWP JSA Sanction Process

There is no form of secure online appeals procedure provided by DWP. Neither is there any support provided in processing the evidence to appeal any decision made by DWP.
Whilst the letter may be distributed by a local Job centre the job seeker is given 1 week to appeal the letter.
The form requires reading completion and returning within the week.
There is space for written submition. For many this may be a challenge. 

CAB

Can local CAB ( Citizens Advice Bureau handle the volume of Appeals that they may be required to support. The chances are that skills are likely to be in demand.
Each appeal would have to reflect any basis that a decision maker my have to make based on DWP guidelines. CAB and other providers have access to CPAG and Rightnet which may assist but there is little online about the Appeals procedure for this. You only have to look at Youtube to see the  need for video's on this and related subjects.

Sanctions -delays-Food banks-U.K

As I read the article below I was struck by the key issue that Food is a vital need within our society and so much more so than during the winter.
The timing of the article / report being made public just prior to Christmas and the winter period I feel is no suprise.
I Have highlighed key comments and my own comments have been added in italics


"An income squeeze, benefit delays and excessive utility bills are blamed by a cross-party group of MPs for a huge rise in the use of food banks.
The inquiry, by Conservative and Labour MPs and church leaders, says many families are one unexpected bill away from financial crisis.
They urge quicker benefit payments, the extension of free school meals and a living wage to reduce hunger.
Ministers called the report a serious contribution to an important debate.
The all-party parliamentary inquiry into hunger in the UK was set up to understand the extent and spread of hunger, food poverty and to investigate its underlying causes.

The inquiry found it difficult to calculate the exact number of food banks in the UK as so many are independent and run by individual groups.
But it did ascertain the number of Trussell Trust food banks has grown from a handful to 420 in the past 10 years. And it heard suggestions there may be at least as many food banks operating independently.
The growth in food bank use is mirrored across Europe and the US, the report said.
It acknowledged UK families on low incomes "have been hit disproportionately hard" by rising living costs and this has eroded the value of their income.
"Too many people living in low-income households often face the choice of putting money in the gas meter or food on the table," it said.
"In addition, they face in many cases a premium on the basic goods and services they buy."
Severe hardship
The report stressed "benefit delays have been a key reason" for people turning to food banks.
It heard much evidence that lengthy delays in the administration and receipt of benefit payments have caused severe hardship for new claimants."
These delays are an issue for many hard working Job seekers and indeed those on low incomes including those on zero hour contracts and part timers
"It concluded: "Benefit-related problems were the single biggest reason given for food bank referrals by almost every food bank that presented evidence to us.

Why are there problems with the administration of the Welfare benefits?
These delays are likely to be on new claiments
It heard the Department for Work and Pensions does not currently collect information on the time taken for benefit payments to be made and said some people were waiting up to 16 weeks for a claim.
This is a 4 mnth delay of which those claiming may well be entitled to payments. Ad that to the issue that such payments may not be entitled to back payment but may be new claiments, How many of us could survive without any money for this length of time
'Too long to survive'
The department measures the average number of days taken between an application and a decision being made on a claim.
"Whilst the department aims for this process to be concluded within 16 days, we heard that for some claimants even this length of time is too long to survive without money," it said.
This is 16 working days therefore over 3 weeks
The authors want benefits to be delivered within five days of a legitimate claim and for more discretionary payments to be made when delays occur.
They also highlight the impact of high utility bills and say the poorest often pay for gas and electricity through prepayment meters, face higher energy costs and are unable to get the best deals.
They also looked at hunger in schools, with some schools estimating up to a quarter of pupils arrive hungry each morning.

While low parental income is an important factor, children often go hungry because of lack of organisation at home, they added.
They want free school meals to be extended to more children of low-income parents and for a campaign to decrease the number of children arriving at school hungry.
The MPs also recommend a national organisation be set up to end the destruction of edible food and ensure more of this goes to those who need it.
On Sunday, the Archbishop of Canterbury, Justin Welby, backed the report, saying more help was needed to prevent families in the UK going hungry.
He said food was being wasted in "astonishing" amounts while hunger "stalks large parts" of the country.
The archbishop said he was left more shocked by the plight of the UK's hunger-stricken poor than those suffering in African refugee camps, because it was so unexpected.
Deputy Prime Minister Nick Clegg said benefits sanctions - for infractions such as missing interviews or failing to take part in a work-related activity - were partly to blame and should not always be imposed "overnight".
Reality is Mr Clegg they are are regularly applied and the over turning procedure takes longer than it should. They are not used as a last resort they are used as a first resort what ever the circumstance.
He told the BBC's Andrew Marr Show: "Whilst it is of course necessary to have sanctions in the benefit system, I think we should introduce a sort of traffic light system so that some of the sanctions are not imposed quite as 'overnight' as they sometimes are.
"That might help alleviate some of the problem."
'Safety net'
A government spokesman welcomed the report's recognition that the reasons behind demands for emergency food assistance were "complex".
"As a country we have enough food to go around, and we agree that it is wrong that anyone should go hungry at the same time as surplus food is going to waste.

"There is a moral argument as well as a sustainability one to ensure we make the best use of resources.

The spokesman said it was important to remember "this country has been through the deepest recession in living memory, and sticking to this government's long-term economic plan is the best way to improve living standards".
He said the plan was working and the economy growing while the welfare system provided a vital safety net.
"In addition, the UK has a proud tradition of civil society and faith groups providing support for people in need, and it is right that their impressive work is recognised in the report.
"Under tough circumstances, communities have shown that by pulling together to help each other, we can build a bigger, stronger society." "

 Employment Support Allowance

Types of ESA

The 2 types of ESA are:
  • contribution-based ESA – usually you get this if you’ve got enoughNational Insurance contributions
  • income-related ESA – usually you get this on its own or on top of contribution-based ESA, if you’re on a low income

Contribution-based ESA

Contribution-based ESA lasts 1 year if you’re in the work-related activity group. You may be able to re-apply at least 12 weeks after your contribution-based ESA ends. You may qualify again depending on:
  • National Insurance contributions you paid in different tax years
  • whether your health deteriorates and you’re placed in the support group
There’s no time limit on how long you can claim contribution-basedESA if you’re in the support group.

Income-related ESA

You may qualify for income-related ESA if you no longer qualify for contribution-based ESA.
How much you get depends on your circumstances. There’s no time limit on income-related ESA.

Benefits sanctions

Your ESA can be reduced if you don’t go to interviews or do work-related activity as agreed with your adviser. The reduction can continue for up to 4 weeks.
You’ll get a ‘sanction letter’. Tell your ESA adviser if you have a good reason for missing the interview.
You’ll get another letter if the decision is made to give you a sanction. Your benefit will only be affected once a decision has been made.

There is a strong argument to say that this is a research to test the public reaction as well as a cost cutting process

Does the tax payer feel that a disabled or ill  person require the funding?

A Sanction-where the money is stopped

The number of sanctions applied are staggering

The DWP sanctions have been Published
Employment and Support Allowance (ESA) was introduced in 2008 to replace incapacity benefit.

In the first three months of 2014, there were 15,955 sanctions on ESA claimants, compared with 3,574 in the same period last year.


Only ESA claimants in the work-related activity group, where an adviser assists them with training and skills, can be subject to sanctions, which are handed out for failing to attend a mandatory interview or failing to take part in a work-related activity.
There are 552,000 benefit claimants in the ESA work-related activity group and they receive up to £101.15 a week, the Department for Work and Pensions (DWP) said.

Matt Downie, director of policy and external affairs at Crisis, said: "This is a shocking escalation in the use of sanctions and we are deeply concerned about the impact on people's lives.
"Sanctions are cruel and can leave people utterly destitute - without money even for food and at severe risk of homelessness. It is difficult to see how they are meant to help people prepare for work.
"Our own research has shown that many homeless people face unfair and inappropriate sanctions, often handed out due to errors on the part of the job centre or work programme provider.
"We want the government to commit to an urgent, wide-ranging review looking at the appropriateness and effectiveness of sanctions, especially for people at risk of or experiencing homelessness."
